I need few information regarding H1B visa in USA.My husband is planning to quit the job here and will be working in USA for few years.He has a valid H1B. He wants me to accompany him, we have a baby who is 1 n 1/2 yr old.My problem is, am a s/w engineer n working here. I dont want to quit the job bcoz of some problems like husband behaviour,his nature etc anyway am trying to keep the marriage bcoz its only 2 n 1/2 yrs gone.so taking a chance.no help from inlaws side and financially those people r dependent on my husband.
So if am travelling with him then I want to have H1B so that I can work there. Then I can handle the problems.If am not working means am gone.Presently I have H4 in which I cant work there in USA.
1 st case:
Can anyone please tell me how far it is possible to transfer H4 to H1B.
Do company in USA recruit the people who is having H4 and later they process for H1B
2nd case:
or pls suggest me if I have to stay here and take a help of a consultancy to get a H1B done here itself in India.

Tranferring from H4 to H1 for new people is going to be tough.

The choice is if you come in H4 you cannot work and there are very consultants who transfer H4 to H1.

So if you think that job is a must for you and you cannot survive without that , I prefer you to apply for H1 also through the same company or different which your husband applied for a visa and get H1B and go there.

Also you have not mentioned whether your husband has got the job here or going to get it. If he' s planning to look for , then it' s not the correct time for you to accompany him.

Donot get scared , just for info I am telling.
Last week we have got a phone call from our friend asking for help for some person. The reason is this

One company processed h1 and he left job and come here. Npbody come in the airport and he took a cab and went to the company and they said we have closed the company and you have to take care of yourself. They dropped him in a motel.
Fortunately he told the problem to the motel and they allow him to stay and passed the info to his friend and he told us. We called some consultants and helped him in some way.

These cases are very common . So be careful about going on here.
If he does not have a job. Let him come. Look for a job. Get settled . Then you come. In between you can apply for H1 B too.


Also one more thing if you want to work , you have to leave your son to daycare. Just for the info.
