Hello friends,
I would like to know one thing. My friends husband has bought 2 properties in solely his name. My friend is afraid that her ILs (2 SILs and MIL,FIL)can claim this property as ancestral because it is in his name only. Is this true ? As his wife, what is my friend' s position in case they separate ? Is there some way by which they can jointly own the property now after 2 years of buying the property ? They have 3 kids (twin sons and a daughter). Please help me on this so I can advise my friend. Thanks a lot in advance.

A property bought my him in current time is NOT ancestral, its his, so he has the RIGHT to give it to anyone he desires, as long as he adequately takes care of his family (your friend). And in case of separation your friend surely can demand a part of his property as much deemed required for her use and of the children' s who live with her post separation.

However with twin sons and a daughter, why talk of separation? Is the marriage so bad? Abusive? You can suggest your friend to post that problem of hers too in this board herself to get better insight, emotional as well as legal.

Thanx dear friend. the marriage as of now is going good, but in the past it has been abusive and his father (my friends FIL) told her once that whatever roperty my son buys, my daughters can claim it, so she is v. insecure about the entire thing, she is worried about her own future, she knows her husband will take care of her kids, but about herself she is unsure becoz her husband listens to his father and cannot say no to anything. so she is afraid that tables may turn and she will not be left with anything. thanks a lot for answering. she is right here sitting next to me but is not v. computer savvy so i am helping her out.
