Dear All,
I was just wondering about the nationality of the baby and how it affects us. I know, being born here, the baby will be considered US citizen. I would like to know, how it works for parents. We are planning to move back to India and we are not citizens here, so how will it affect the baby's citizenship. Also, can baby have dual citizenship? Any information on this topic is welcome.

Your child's citizenship is her birth right and it will not be cancelled until she gives it up volunterily.
Your child is eligible for both Indian and US citzenships till she is 18. So, she will be an Indian citizen in India. Nothing special needs to be done. However, it is better to claim her Indian citizenship by applying for an Indian passport for her.
When the child reaches the age of 18 and India still does not allow dual citizenship, she would have to choose between her Indian or US citizenship.
Above is information I found from Ammas website.
I think parliment has already passed the bill for dual citizenship earlier this year. So, hopefully this will not be needed.

regarding citizenship, I am also confused. Actually my sil had her baby in US and she has taken a certificate from the Indian embassy which is PIO - Parents of Indian Origin. This certificate is valid for 15 years for the baby and it works well cos after that the baby might want to come back to US to study further or anything like that. And also as the dual citizenship law is in place now, its going to take approx 8 months for it to be formalised. so may be by the time you return back, you can apply for the INdian passport as well...

If I am remembering it correct, Prime Minister Atal Bihari Bajpayee has agree on dual nationality for those who live in US, Australia and Newzealand.
And I also think you can ask for Indian passport for your baby.
Your baby will have two nationality. It used to be that people like you will take their baby home country with American passport and then get another Indian passport there. It used to be possible as baby by definition was born to Indian Citizens and not necessarily these kids have had to wait for 5 years stay to get nationality.
Your best bet is Indian Embassy and things will be clear to you when you give a call to them.
