hi guys,
My mom got her visa yest. She got a 6 month visa. I have a small doubt actually.... her visa date says July 7th thru Jan 6th. But my mom will be coming ony in Sept , Can she stay for 6 months then? Is it the visa date or the I94 date that we have to follow. I think the visa date is only for entry and once she comes here ,we should go by whatever the I94 stamp says... What are ur views...

don't worry.......she has to arrive within that time in the country......for how long she can stay in the country depends upon the visa officer i mean to say that she will get the entry to stay there on arrival.

if as Anu said she has to go back when visa expires, try to get an extension. No harm trying even u don't get an extension. u will get details of applying for extension thru www*path2usa*com/Extensionvisa*htm
(replace * with .)

Some tips that may help u..
Warnings givenon path2usa :
Don't apply for the extension of the visa limit immediately after arriving into USA, as the INS officials might take it as a pre-planned act. It is always better to apply after 2-3 months stay.
2) It should be applied atleast 2 months before your I-94 expiry date.

( Remember: The date of expiry of your stay limit, is the date on the I-94 form tag attached to your passport, and not the date stamped on your visa. )

Usually these are the same dates, but in some cases it might differ.
(so there is still hope..maybe she may stay after all for 6 months.)

Hi Vidhya,
Let me first congratulate you & your mom for getting the visa successfully. Do not get confused about the date of expiry. As per Bargavi's advice, its not a good idea to extend the visa in her first visit itself. Read this link below. This should definitely answer all your queries.

So you can send a letter requesting the immigration officer (I94) to grant six months of stay to your mom from the date of entry in US. Send this letter to your mom, and ask her to show it at the time of entry here, so that she need not even talk to the officer.

Hi Vidhya

Why did they give just 6 month visa? From a long time i was hearing that they are giving multiple entry 5/10 years visa.
I have heard of visa extensions, for more detail you can check path2usa*com.
I think after coming here she can apply for 6 months extension, without that as Anu said she can not legally extend her stay beyond Jan 6th.

I agree with Bhargavi. It is not a good idea to extend visa in the first visit itself. I heard it will be a problem for the next trip.

Hey Vidhya,

If your mom's visa date say July 7th thru Jan 6th, it means she is eligible to stay in US maximum upto Jan 6th. When she arrive into US, I94 date will mostly be same as Jan 6th or less than that. But it will never be more than the visa expiry date i.e Jan 6th for your mom. Even though she got 6 months visa, she will be able to stay with you maximum upto Jan 6th or I94 date. As I said, I94 date will never be more than the visa expiry date. Instead of asking her to come in Sep, you can ask her to come here during Aug so that she gets more time to spend with you.
