Q: Under what circumstances can a non-immigrant get a nanny/housekeeper for his children from his home country? What visa would that person hold?

A: Various non-immigrant visa holders can bring in a nanny from their home country. Basically, one of two circumstances must exist: 1) the nanny must have worked for the non-immigrant for at least one year in the past, or 2) the non-immigrant must commonly employ domestic workers, the nanny must have at least one year of experience, and the employment relationship must have commenced prior to the non-immigrant having entered the U.S. The nanny would use the B-1 category, and would have to apply for work authorization upon entering the country. Please note this use of the B-1 is limited to non-immigrants and, in some circumstances, U.S. citizens. Permanent residents are not allowed to employ a domestic worker from their home country under the B-1 visa.
