Hi, Does anyone know what should be your visa status in order to adopt from India? We are in USA & in the middle of Greencard. Our lawyer thinks we can't adopt at this stage. We got wait for 2yrs to adopt a baby once green card is approved. Thanks in advance.

You can adopt from india but cannot bring the child back to the US until you have resided with him/her in India for 2 years.

Either you or your spouse must be a US citizen in order to file for the child's immigration to the US.

There is a petition online (please do a search) that people are signing to ask that this law be changed.

Good luck. Don't give up...it'll be worth the wait in the end.

Hai Vibha,
I have seen your answer to MKS about NRI Adoption Status.
Me and my husband , we live in USA.We are still in the green card process.We have decided to adopt from India.
Could you please help me know the possibilities of adoption for us,either through US agency or directly from Indian Agency.It would be great if you could please help us make us clear.You said to Mks that they can adopt but they have to wait for 2 years.You also said that one of the spouse should me US citizen in the second line.I am bit confused.Is it possible to adopt even though none of us is US citizen, if we wait 2 years before we bring the child to US.
