Due Date Club February 2006:Need help urgently

Hi!
This is a question regarding the visitor visa. I was on a H4 visa and early this year I have been approved for a L2 visa(becoz my hubby moved from H1B to L1A). After the approval I have not travelled to India. So my passport still has H4 visa stamping only and not the L2. At the consulate when they ask my parents, what visa is your daughter/son-inlaw on? What do you suggest the answer should be? Should it be H4 and H1B OR L2 and L1A? Kindly let me know? Wondering if the systems are linked and if they say H4 the consulate may get to know that I am now approved for a L2........Worried and not sure what to say. Kindly let me know.

Sonu,

There are two different things. One is ur current status and other is Visa. Visa is only required if you go out of country.
Ur current status(which in ur case is L1) is what matters not the visa what is stamped on the passport.
So ur current status is L1-L2 not H1-H4(ur H1 already has expired becoz u got the approval for L1). Visa which is stamped on ur passport is only for ur travel purpose. Definetely u can not use ur I-797(L1 approval notice)for Visa because that will be approved only when u go out of country...

So ur parents should tell about L1 not h1.

i hope this clears ur doubt. Which consulate ur parents r going..I have hear in Mumbai denial rate is higher as compared to delhi.

As per my understanding ur husband is the primary visa holder and u r the dependent. So ur visa status should not come into picture when ur parents go for their visa.They should show the papers for ur husband's visa not urs. And also ur parents should not mention H4 as that visa has already expired.

Thanks for your reply. Even if my visa doesn't come into picture, the same question applys to my husband's case. Our L visas have been approved BUT our H visas have not yet expired they are valid until mid next year.

I read the L visa approval notice carefully and it says that " This may not be used as a visa OR may not be used in place of a visa" It mentions that it is ONLY a means to obtain a visa. Thats why was so confused. Anyways shall see. Shall update you asap.Thanks again.
