Hello. We are adopting a child from India. We have made adoption deed from local tehsil and received the child. Then applied for guardianship order at dist court where child lives with our sister. Dist court judge did not allow the petition saying that we should have applied in the jurisdiction where biological parents live. Is that the condition. Can we apply to high court. DO the high court (it covers the jurisdiction both for biological parents and where child lives now) has the authority to allow the petition. Dear Soma, I was glad to read your post here. With much difficulty I have found some place online that I feel is trustworthy (I hope & pray I am not wrong). If you haven't found your angel yet... Please write to me. I am planning adoption for my yet-to-be-born baby (Sorry, I do not know if itâ€™s a he or a she) due in March/April 2011. I am 9 weeks pregnant as I write. I belong to the similar background (I mean we belong to the same state of WB & I am a Brahmin and my estranged husband is Kayastha), busy with a career plus not in a conducive relationship. I do not think I would ever be in the right frame of mind to grow upraising a child. Yes, now that I have it, I wouldn't deny it the right to live. I would give you all possible details at this stage albeit not on this platform but via e-mail communication. I am in India (in one of the top metros). I absolutely do not want to give my baby for foreign adoption. I want Indian/Bengali parents for him/her. All I want is a safe, secure, happy, fulfilling life. We met a fly who stays in Mumbai, they are basically from Haryana. As me & my Husband are planning to do for an adoption they referred us a baby girl from their village in Haryana. As the girl was the 6th child (all 6 girls) and the fly is poor and wanted to abandon the child the doctors from the PHC are searching a good fly for her. But as we asked them to go from proper adoption channels, they refused. According to them they will provide us the Birth Certificate and legal papers from court where they will state that the Biological Parents will have no rights on the child and demanding for money as the family is poor... Why are there different laws for Indian nationals who are Muslims, Parsis, Christians or Jews? I am hurt. Are we not Indians? Why this demarcation.. We brag about being the biggest democracy and we have these inequalities. The law itself is dividing people. I was born and raised in India and thats very much my motherland. Than why am I different from my other friends??? Why are the laws different for me???
